บุคคลซึ่งให้บริการหรือแสดงต่อบุคคลทั่วไปว่าพร้อมจะให้บริการเป็นนายหน้าหรือตัวแทน
เพื่อซื้อขายหรือแลกเปลี่ยนสินทรัพย์ดิจิทัลให้แก่บุคคลอื่นโดยกระทำเป็นทางค้าปกติและได้รับค่าธรรมเนียมหรือค่าตอบแทนอื่น
แต่ไม่รวมถึงการเป็นนายหน้าหรือตัวแทนในลักษณะที่คณะกรรมการ ก.ล.ต. ประกาศกำหนด
ผู้ค้าสินทรัพย์ดิจิทัล
(Digital
Asset Dealer) หมายถึง
บุคคลซึ่งให้บริการหรือแสดงต่อบุคคลทั่วไปว่าพร้อมจะให้บริการซื้อขายหรือแลกเปลี่ยนสินทรัพย์ดิจิทัลในนามของตนเองเป็นทางค้าปกติ
โดยกระทำนอกศูนย์ซื้อขายสินทรัพย์ดิจิทัล
แต่ไม่รวมถึงการให้บริการในลักษณะตามที่คณะกรรมการ ก.ล.ต. ประกาศกำหนด
ที่ปรึกษาสินทรัพย์ดิจิทัล
(Digital
Asset Advisory Service) หมายถึง
บุคคลซึ่งให้คำแนะนำแก่ประชาชนไม่ว่าโดยทางตรงหรือทางอ้อมเกี่ยวกับคุณค่าของสินทรัพย์ดิจิทัลหรือความเหมาะสมในการลงทุนที่เกี่ยวกับสินทรัพย์ดิจิทัลนั้น
หรือที่เกี่ยวกับการซื้อ ขาย หรือแลกเปลี่ยนสินทรัพย์ดิจิทัลใด ๆ เป็นทางค้าปกติ
ทั้งนี้ โดยได้รับค่าธรรมเนียมหรือค่าตอบแทนอื่น
แต่ไม่รวมถึงการให้คำแนะนำอันเป็นส่วนหนึ่งหรือเกี่ยวเนื่องกับการประกอบการของศูนย์ซื้อขายสินทรัพย์ดิจิทัล

เพื่อแสวงหาประโยชน์จากสินทรัพย์ดิจิทัล โดยกระทำเป็นทางค้าปกติ
แต่ไม่รวมถึงการจัดการเงินทุนสินทรัพย์ดิจิทัลในลักษณะที่คณะกรรมการ ก.ล.ต.
ประกาศกำหนด
"Digital Asset Business Operator" refers to a licensed operator of digital asset businesses, but not including operators who are commercial banks under the law on financial institutions, insurance companies under insurance law, and securities companies under the law on securities and exchange. Digital asset businesses are categorized into three types: (1) digital asset exchange; (2) digital asset broker; and (3) digital asset dealer.
Digital
asset exchange means a center, or a network established for trading or
exchanging of digital assets, which operates by matching orders or arranging
for the counterparty or providing the system or facilitating a person who
wishes to trade or exchange digital assets to enter an agreement or match the
order, in the normal course of business, excluding the center or network in the
manner as specified in the SEC's notification.
A digital asset broker means a person who provides services or holds itself out to the public as available to provide services as a broker or an agent for any person concerning the trading or exchange of digital assets in the normal course of business, in consideration of a fee or other remuneration, excluding the brokers or agents who act in the manner as specified in the SEC's notification.
Digital asset dealer means a person who provides services or holds itself out to the public as available to provide services regarding the trading or exchange of digital assets for its account in the normal course of business outside the digital asset exchange, excluding the dealers who act in the manner as specified in the SEC's notification.
